TERMS & CONDITIONS

1. Acceptance of Terms

By accessing or using the Nyumbani BNBS platform — including its website, applications, and related services — you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not use the platform.

2. Platform Role

Nyumbani BNBS operates as a marketplace connecting hosts and guests. We are not a party to the rental agreement between a host and a guest. We do not own, manage, or control any listed properties.

Hosts are solely responsible for the accuracy of their listings, the condition of their properties, and compliance with all applicable Kenyan laws and regulations.

3. User Accounts

• You must provide accurate, current, and complete information when registering.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must not share your account with or transfer it to any third party.
• Nyumbani BNBS reserves the right to suspend or terminate any account that violates these terms.

4. Arrangements & Payments

• Nyumbani BNBS is a listings marketplace only. We do not process, hold, or facilitate any payment between a host and a guest or renter.
• Stay dates, rent, deposits, and payment method are agreed directly between the host and the guest or renter, off-platform.
• Prices shown on listings are in Kenyan Shillings (KES) unless otherwise stated, and are set by the host — Nyumbani BNBS does not verify or guarantee them.
• Hosts may pay Nyumbani BNBS directly for optional listing subscriptions or boosted placement; these fees are unrelated to any arrangement between a host and a guest.

5. Cancellations & Disputes

Because arrangements and payments happen directly between hosts and guests, Nyumbani BNBS is not able to process cancellations, refunds, or payment disputes. Any cancellation policy or house rules stated on a listing are set by the host, not Nyumbani BNBS. See our How It Works page for more on how arrangements and disputes are handled.

6. Prohibited Conduct

• You must not use the platform for any unlawful purpose.
• You must not post false, misleading, or fraudulent listings or reviews.
• You must not harass, threaten, or harm any other user of the platform.
• You must not attempt to circumvent any platform fees or security measures.
• You must not use automated tools to scrape or extract data from the platform.

7. Limitation of Liability

To the fullest extent permitted by law, Nyumbani BNBS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform or any booking made through it.

Our total liability to you in connection with any claim shall not exceed the total amount paid by you directly to Nyumbani BNBS (e.g. for a listing subscription or boost) in the six months preceding the claim.

8. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Kenya. Any disputes arising shall be subject to the exclusive jurisdiction of the Kenyan courts.

9. Changes to These Terms

Nyumbani BNBS reserves the right to modify these terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms. We will notify registered users of material changes by email.
